OFFICIAL RULES: HOOPS HYSTERIA PICK'EM BY ROUND
These are the official rules (the "Official Rules") for HOOPS HYSTERIA PICK'EM BY ROUND (the "Promotion").
No Purchase Necessary To Play or Win. One (1) valid entry per entrant.
This Promotion is subject to all federal, state, and local laws. Void where prohibited.
Administrator & Sponsor: SportsBallot, Inc., 468 N. Camden Drive, Suite 200, Beverly Hills, CA, 90210.
1. Eligibility:
This Promotion is open to legal residents of the 50 United States and the District of Columbia (EXCLUDING PUERTO RICO, OVERSEAS MILITARY INSTALLATIONS AND OTHER U.S. TERRITORIES) who are 18 years of age or older as of the date of entry and who are registered members of the SportsBallot program (an "Entrant").
Entrants must fill-in all contact information to be eligible to win.
Current or former employees and directors of Administrator and their respective parent, subsidiary and affiliated companies, and their respective advertising and promotion agencies, and the immediate family members (spouses, parents, children, siblings or any members of the same households) of each shall be ineligible to participate in the Promotion and shall be ineligible for any prize covered herein. The parties acknowledge that Administrator is not liable for reimbursement of any prizes otherwise payable to Promotion Entrants who are in violation of this provision.
Participation in the Promotion constitutes Entrant's full and unconditional agreement to these Official Rules and to Administrator's decisions. The decisions of the Administrator regarding all matters relating to the Promotion are final and binding.
2. Gambling Prohibition:
This Promotion is strictly for entertainment purposes and may not be used in connection with any form of gambling.
3. Promotion Period:
The Promotion begins on March 2, 2009 at 12:00 a.m. Eastern Time and ends on April 6, 2009 (or upon the completion of the Championship Game in the 2009 Division 1 Men's College Basketball Tournament) at approximately 9:00 p.m. Eastern Time (the "Promotion Period").
4. How to Enter:
SPORTSBALLOT REGISTRATION: To enter the Promotion, you must be a registered member of the SportsBallot program. Although the SportsBallot program is offered on multiple websites, each participating site refers to the same Promotion. An Entrant may only have one (1) entry in the Promotion. Registration is free. If Entrant is not a member, Entrant may register by clicking on the "New User" link on the entry page for the Promotion and following the instructions. Entrant will be asked to provide his/her name, e-mail address, city, state, zip code, birth date, gender and to select a username and password. To complete his/her registration, Entrant must click on the "Register" button.
As a registered member of the SportsBallot program, Entrant may enter the Promotion by first logging into the system with Entrant's current username and password. Entrant may then be asked to consent to receive promotional emails or offers. Consenting to receive promotional emails or offers is optional and does not have to be agreed to in order to be eligible to enter the Promotion or to win a prize.
Limit: One (1) entry per person (regardless of whether one person has more than one email address) or email address (regardless of whether more than one person uses the same email address).
Neither Administrator nor its affiliates are responsible for lost, late, incomplete, damaged, stolen, invalid, unintelligible or misdirected entries, which will be disqualified. Neither Administrator nor its affiliates are responsible for any unavailability of or interruptions to any service or equipment used in connection with the Promotion including, without limitation (1) interruptions to any network, server, Internet website, telephone, satellite, computer or other connections, (2) failures of any telephone, satellite, hardware, software or other equipment, (3) garbled, misdirected or jumbled transmissions, or traffic congestion, (4) other errors of any kind, whether human, technical, mechanical or electronic, or (5) the incorrect or inaccurate capture of entry or other information or the failure to capture any such information.
5. How to Play:
(a) General: The objective of the Promotion is to accumulate the most points by correctly selecting the winning teams in the 2009 Division 1 Men's College Basketball Tournament. The tournament consists of sixty-three (63) games. A 64th (the "play-in") game is played, Tuesday, March 17, 2009. Entrants are automatically given the winner of the play-in game. No points are awarded for the play-in game.
(b) How to make your selections for the 1st Place Ballot Prize (see rule 6 (a)): The tournament team selection process will take place, Sunday, March 15, 2009. Once the tournament teams are selected and the official bracket is set for 2009 Division 1 Men's College Basketball Tournament (official bracket will be set at approximately 8PM ET on March 15, 2009), Entrants will be able to login to the SportsBallot program and click the "Hoops Hysteria Pick'em By Round" link to make their selections. Entrants will attempt to correctly select the winner of each game in Round One (1) and Round Two (2) prior to the start of the first game in Round One (1) held, Thursday, March 19, 2009. After all games in Round One (1) and Round Two (2) are finished, Entrants may return to the Promotion to attempt to correctly select the winner of each game in the Sweet Sixteen (16) and Elite Eight (8) prior to the start of the first game in the Sweet Sixteen (16) held, Thursday, March 26, 2009. After all games in the Sweet Sixteen (16) and Elite Eight (8) are finished, Entrants may return to the Promotion to attempt to correctly select the winner of each game in the Final Four (4) and Championship Game prior to the start of the first game in the Final Four (4) held, Saturday, April 4, 2009. To submit their selections, Entrants must click the "Submit Bracket" button. Once the entry is officially submitted, the screen will say "Your Ballot Has Been Submitted." Entrants may change their selections as often as they like prior to each Deadline. After each Deadline, no selections may be changed.
(c) Scoring: Entrants will earn points by making correct selections. Here is the point breakdown:
ROUND 1: One point will be awarded for each correct pick (32 games = 32 possible points)
ROUND 2: Two points will be awarded for each correct pick (16 games = 32 possible points)
SWEET 16: Four points will be awarded for each correct pick (8 games = 32 possible points)
ELITE 8: Eight points will be awarded for each correct pick (4 games = 32 possible points)
FINAL 4: Sixteen points will be awarded for each correct pick (2 games = 32 possible points)
FINALS: Thirty-two points will be awarded for the correct pick (1 game = 32 possible points)
Total possible points = 192 points
(d) Deadline: Entrants must submit their selections by the Deadlines set forth below:
The Deadline to submit bracket picks for Round One (1) and Round Two (2) is thirty (30) minutes before the scheduled start of the first game in Round One (1) of the tournament. The Deadline to submit bracket picks for the Sweet Sixteen (16) and Elite Eight (8) is thirty (30) minutes before the scheduled start of the first game in the Sweet Sixteen (16). The Deadline to submit bracket picks for the Final Four (4) and Championship Game is thirty (30) minutes before the scheduled start of the first game in the Final Four (4).
IMPORTANT: Your selections must be submitted, received and recorded by Administrator's computer by the scheduled Deadlines. Selections submitted after the Deadlines are considered invalid. Administrator's computer is the official time-keeping device for this Promotion. Proof of submission of a ballot does not constitute proof of receipt.
(e) Ties: If there is a tie for the 1st Place Ballot Prize, the one (1) tiebreaker question will be used to select the prize winner. The tiebreaker question is "What will be the final score of the championship game, currently scheduled on Monday, April 6, 2009?" In all cases, an Entrant that does not enter a tiebreaker answer will not be considered. The predicted championship game scores are compared to the actual championship game score. The differences between the predicted scores and actual scores for each team are calculated and added. The Entrant with the smallest total difference is considered the winning entry. If more than one Entrant has the smallest total difference, a random computer drawing among those remaining Entrants will be conducted to select the one (1) 1st Place Ballot Prize winner.
6. Prizes:
(a) 1st Place Ballot Prize:
The 1st Place Ballot Prize is a Canon PowerShot 10.0-Megapixel Digital ELPH Camera (Model: SD790 IS). The approximate retail value ("ARV") of the 1st Place Ballot Prize is $200.00. The 1st Place Ballot Prize will be awarded to the Entrant who accumulates the highest point total in this Promotion. The tiebreaker question will be applied if necessary (see rule 5 (e)).
Each winner is responsible for all federal, state and local taxes and may be required to complete an IRS form W-9 or the equivalent. Sponsor reserves the right to withhold prizes until completed form W-9 is received.
Prize winners should allow up to 30 days after they return their signed, notarized affidavit to receive their prize. Prizes returned as undeliverable or otherwise not claimed within fourteen (14) days after being sent will be forfeited.
Sponsor is not responsible for lost or stolen prizes. Prizes are non-refundable and nonexchangeable. Sponsor reserves the right to substitute a prize of equal or greater value, the right to change, modify, or extend Promotion dates if it should be deemed necessary.
7. Potential Winners:
All potential winners are subject to verification by Administrator, whose decisions are final. Administrator shall solely determine any form of verification. An Entrant is not a winner of any prize unless and until Entrant's eligibility and the potential winning entry has been verified and Entrant has been notified that verification is complete.
Administrator will not accept screen shots, affidavits or other evidence of winning in lieu of its validation process. Any entry that occurs after the system has failed for any reason may be deemed a defective entry and void.
All potential winners will be notified via email. A potential winner will be disqualified and an alternate potential winner may be selected (i.e., the person with the next most points) if (i) he/she does not comply with these Official Rules (or is otherwise determined to be ineligible), (ii) he/she does not respond to the prize notice within seven (7) days of its transmission, or if the emailed prize notice, after three (3) attempts, is returned as undeliverable, or (iii) the prize is undeliverable for any reason, or (iv) fails to complete, sign and return an Affidavit of Eligibility, a Liability Release, and, except where prohibited, a Publicity Release, within fourteen (14) days of the date stated on the prize notification. If Sponsor notifies, or seeks to deliver a prize to or otherwise attempts to contact an alternate potential winner, and such alternate potential winner is subsequently disqualified, then Sponsor shall use its reasonable business judgment to determine, in its sole discretion, the disposition of the prize (e.g., may choose another alternate potential winner in a manner consistent with these Official Rules or donate the prize to another entity, or not award the prize, at it's sole discretion).
By participating in this Promotion or receiving a prize, Entrants (and in particular, winners) agree to release, indemnify and hold harmless Administrator and its affiliates, and all of their company's officers, directors, employees and agents (collectively, the "Released Parties") for any liability, injury, death, loss or damages to Entrant or any person or entity, including without limitation damage to personal or real property, caused in whole or in part, directly or indirectly, by participation in this Promotion (or related activities) or the acceptance, possession or use/misuse of a prize (including any travel or activity related to the prize, if applicable).
Except where prohibited, participation in this Promotion constitutes winner's consent to Administrator or its affiliates use of winner's name, likeness, voice, opinions and biographical information for publicity, advertising, trade or promotional purposes in any media or manner, now known or hereafter devised, worldwide, without further payment, consideration, notice or approval.
8. Identity Disputes:
In the event of a dispute about the identity of the online Entrant, entries will be declared made by the authorized account holder of the e-mail address submitted at time of entry. The authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be required to provide Administrator with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.
9. Game Modification:
Administrator reserves the right in its sole discretion to modify, cancel, terminate or suspend this Promotion without advance notice for any reason including, without limitation, if (i) viruses, bugs, unauthorized human intervention, fraud, technical failure or other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion; or (ii) earthquake, flood, fire, storm or other natural disaster, act of God, labor controversy or threat thereof, civil disturbance or commotion, disruption of the public markets, war or armed conflict (whether or not officially declared). Administrator reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of the Official Rules. If for any reason the Promotion cannot be conducted as planned, Sponsor reserves the right to modify or terminate the Promotion and select winners from entries received as of the date the Promotion is terminated.
10. Limitations of Liability:
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment, hardware, software or programming associated or used with the Promotion; (2) technical errors, defects, delays or failures of any kind including, without limitation, malfunctions, interruptions or disconnections in communications lines, Internet or website access, hardware or software; (3) digital or electronic disruptions, e.g., viruses other security breaches; (4) unauthorized human intervention, e.g., hacking; (5) technical or human error which may occur in connection with any aspect of the Promotion; (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant's participation in the Promotion, access to, copying or downloading materials from Promotion or any other website, or receipt or use of any prize.
11. Official Rules/Winner Lists:
For a copy of these Official Rules and/or a list of winners, mail a self-addressed stamped envelope to the address below. Such requests must be received by Administrator within thirty (30) days following the end of the Promotion (i.e., by May 6, 2009).
